A number of U.S. states debated during the 2007 legislative sessions whether to add sexual orientation and sometimes gender identity to workplace, housing and other civil rights laws.
Washington Post, Posted: 6/8/2010, 8:32 AM A study by a prominent gay rights organization found that half of 17 Washington area hospitals do not explicitly include "sexual orientation" or "gender identity" in their patients' bill of rights or nondiscrimination policies. The report by the Human Rights Campaign Foundation follows President Obama's mandate that nearly all hospitals protect the visitation and health-care decision-making rights of gay men and lesbians. Eight Washington area hospitals, the report says, do not include such language. They are Sibley Memorial, Howard University and Providence hospitals in the District; Shady Grove Adventist Hospital and Washington Adventist Hospital in Montgomery County; Reston Hospital Center and Virginia Hospital Center in Northern Virginia; and Doctors Community Hospital in Prince George's County. But in an interview, a spokesman for Howard said its patients' rights policy does, in fact, include a reference to sexual orientation. Tom Sullivan, a co-author of the HRC report, said he had been unable to find it on the hospital's Web site. Including the explicit language is important, the group said, to train and educate hospital staff and to codify the hospital's commitment to full inclusiveness "in a very visible way," according to Sullivan.

Ian Jolly was told he could not take guide dog Nudge into Adelaide's Thai Spice last May because a member of staff objected, The Sunday Mail reported. The restaurant's owners said a misunderstanding had arisen between Jolly's female companion and a waiter who understood the woman "to be saying she wanted to bring a gay dog into the restaurant". "The staff genuinely believed that Nudge was an ordinary pet dog which had been desexed to become a gay dog," the owners said in a statement to South Australia's Equal Opportunity Tribunal. The tribunal on Friday ordered the restaurant to pay Jolly US$1,400 and offer him a written apology for discriminating against him on the grounds of disability. The restaurant, which displays a "guide dogs welcome" sign, refused to comment to the newspaper and was unavailable to respond on Sunday. Jolly told the Sunday Mail he was happy with the result. "I just want to be like everybody else and be able to go out for dinner, to be left alone and just enjoy a meal," he said.
St. Louis Post-Dispatch, Posted: 3/26/2010, 10:48 AM Civil rights legislation that would make it illegal to discriminate against gays and lesbians in Missouri moved past an obstacle Monday that had stood in its way since 2001. The bill is sponsored by Rep. Stephen Webber, an Iraq war veteran who served two tours of duty. At 26-years-old, he is the youngest member of the Missouri House, and he is not gay. For nine years, various Democrats have filed a bill in the Legislature that would add "sexual orientation" to Missouri's nondiscrimination act. Until Monday evening, the bill had never had a House hearing. But Monday, Webber (D-Columbia), presented his bill to the House committee on urban affairs and urged lawmakers to take "one step at a time" in advancing civil rights protections to gays. The bill seems unlikely to advance in the Republican-controlled Legislature, but still, advocates of civil rights for gays and lesbians were encouraged that the bill finally had a hearing. Webber's bill would prohibit discrimination based on sexual orientation in employment, housing and public accommodations. Joan Gummels of the attorney general's office testified that the civil rights division of her office receives complaints about discrimination based on sexual orientation but that they are basically ignored because such discrimination is not against the law in Missouri.

Rejecting Democratic demands that he seek last-minute legislation to add anti-bias safeguards to state law, McDonnell yesterday said his public pledge to oppose prejudice and fire those guilty of it is sufficient. “I believe that takes care of it,“ said McDonnell, ducking a question on whether he chose not to press legislation to avoid angering his conservative Republican base. The Democrat-dominated Virginia Senate endorsed a measure to include sexual orientation in anti-discrimination laws. The proposal died in the GOP-controlled House of Delegates. McDonnell this week issued an “executive directive” extending largely symbolic protections to gay public employees. He was forced to act because of the furor over an opinion by Attorney General Ken Cuccinelli that there is no legal basis for the state’s public colleges to protect gay students and employees from bias based on sexual orientation. Cuccinelli, a Republican, yesterday stood by his view and noted that it mirrors a 2006 opinion by McDonnell when he was attorney general. “We certainly don’t see anything that the governor would do by himself without the General Assembly as changing the policy of Virginia,“ Cuccinelli said.

McDonnell's executive directive this week banning discrimination in the state government's personnel actions on the basis of sexual orientation. The first is that Mr. McDonnell, pilloried during the 2009 campaign for the conservative social views expressed in his graduate thesis, would take such an action at all. And the second is the broad reasoning he used to support it. Mr. McDonnell gained national attention last fall when his opponent, Democrat Creigh Deeds, started making an issue of the Republican's thesis as a graduate student at Regent University, which, among other things, took a dim view of "cohabitators, homosexuals or fornicators." And as attorney general, Mr. McDonnell had held that only the legislature could extend legal protections to gays. That stance was similar to the one taken recently by current Virginia Attorney General Ken Cuccinelli. He sent a letter earlier this month to public colleges and universities in Virginia advising them to remove any language from their discrimination policies related to sexual orientation, setting off an uproar on campuses across the state. The executive directive seems to have largely quashed that, with campus officials and advocacy groups (other than the Virginia Democratic Party) expressing at least qualified support for Mr. McDonnell's action. Even if this step had modest legal force, it was backed up by a clear and sweeping affirmation of gay rights.

Bob McDonnell. James City County Republican Sen. Tommy Norment added the "sexual orientation" amendment to SB739 when it was heard by the Senate Finance Committee earlier this week. His language called for the state to maintain "an ecumenical atmosphere in its sexual orientation hiring policies." And it was Norment who asked his colleagues to remove it Thursday on the Senate floor, reasoning that the anti-discrimination edict McDonnell issued Wednesday afternoon solves the situation he hoped to address with the amendment. He also suggested the House of Delegates would kill the bill if the sentence weren't axed. McDonnell issued an executive directive to state agencies instructing them not to discriminate in the workplace for any reason or characteristic, including sexual orientation. That decree doesn't have the force of law that an executive order has. The governor took that action in response to the backlash generated by Attorney General Ken Cuccinelli's letter to state colleges and universities prohibiting them from adopting policies protecting workers from discrimination based on their sexual orientation or gender identity.

Equality Virginia yesterday called on Gov. Bob McDonnell to introduce legislation amending the state Human Rights Act to prohibit discrimination based on sexual orientation. The request came after Attorney General Ken Cuccinelli issued an opinion telling state colleges and universities last week that they could not have policies banning discrimination against gays and lesbians. McDonnell has canceled an executive order banning such discrimination in state government, an order he had opposed in 2006 when he was attorney general. "Repeating that you believe discrimination based on sexual orientation is wrong no longer carries any weight," Jon Blair, Equality Virginia's chief executive, wrote to the governor. "The attorney general's and your legal opinion makes crystal clear you believe . . . that neither you nor any state officer has authority to hold anyone accountable when they practice such discrimination." Chris Freund, vice president of The Family Foundation, said he doesn't understand what about Cuccinelli's letter concerned people. "All he was doing is telling his clients what the law is," Freund said. He added that it may be time to ask whether any kind of antidiscrimination law is needed. Only a small number of people are prejudiced and act on that, he said.

The Gender Expression Non-Discrimination Act (GENDA) is now in the State Senate Investigations and Government Operations Committee. If it passes the Senate, Governor David Paterson has said he will sign it into law. "This is an important and overdue protection of human rights," said Assembly Member Richard N. Gottfried, sponsor of bill, A.5710-A. "The experience of transgender individuals, and the discrimination they face, are unique, and should be specifically identified and unambiguously rejected in our State's civil rights laws, just like discrimination based on age, sex, sexual orientation, religion, race, disability, or ethnicity." The transgender community is not protected under current state law. Albany, Buffalo, Ithaca, New York City, and Rochester, and the counties of Suffolk and Tompkins have already enacted local GENDA laws. Thirteen states, Washington, D.C., and over 90 other localities across the country have passed transgender-inclusive civil rights legislation. Over 150 Fortune 500 companies, including 26 located in New York State, have policies in place to protect their transgender workers.
