The nation's first gay-union ceremony should be performed in Canberra by the middle of the year. Gay lobby groups were jubilant at Rudd's declaration, but conservative religious campaigner the Reverend Fred Nile said Canberra had cemented its reputation as a "place of vice." Nile has called for a blanket tourism boycott of the national capital. "Nobody have a holiday in Canberra," he ordered. Rudd could have used his territory powers to override the ACT gay union laws, as the previous Liberal government did. But he said yesterday it was not Labor policy to interfere with state and territory legislation.

Organizers said they checked in 37 couples for an outdoor ceremony on the plaza of the New Hampshire Statehouse _ the building where the law was adopted and signed in 2007. Participants bundled up against below-freezing temperatures. "We've been together 20 years; we've been waiting for this moment for 20 years; finally the state will recognize us as we are," said Julie Bernier, who posed for photos on the Statehouse steps with partner Joan Andresen before the ceremony. As ceremonies go, the outdoors event that began at 11 p.m. Monday was equal parts political rally, party and personal triumph.

In fact, they will not be treated equally, either inside New Hampshire or beyond its borders. They will fall into a separate, evolving legal class recognized by only a handful of states. And more than 1,100 federal laws will discriminate against them regardless where they live. Gay couples taking advantage of the law , which takes effect tomorrow, indeed acquire substantial new state protections ranging from important health benefits to the ability to inherit without a will. But they will be treated legally as two unmarried adults in all but New Jersey, Vermont, Connecticut and California.

Gov. John Lynch signed the civil unions bill into law this spring, calling it an important step in ending discrimination. Meanwhile in the Legislature, a group of conservative lawmakers has sponsored a bill to prevent New Hampshire from recognizing civil unions and same-sex marriages performed out of state. Karen Testerman, head of the conservative Cornerstone Policy Research group, says she has no immediate plans to push for an overturning of the civil unions law but will continue promoting her belief that heterosexual couples make the best parents. Fergus Cullen, chairman of the state Republican Party, says civil unions are evidence the Democrat-dominated Legislature is pushing an agenda on the state

The new law guarantees heterosexual or homosexual couples who have lived together continuously for more than five years social benefits enjoyed by married couples such as joint property ownership and hereditary rights. The text recognizes "two people -- of any sex, identity, orientation or sexual option -- who maintain an emotional relationship sexual in nature, that is exclusive, stable and permanent, without being united in matrimony." The bill sparked intense debates in both houses of Congress before it was approved by a majority of the leftist ruling coalition.

It has been a quick reversal for New Hampshire, where as recently as 2004 lawmakers reacted to Massachusetts’ gay marriage law by passing a ban on recognizing those unions here. Beginning in 2008, five of six New England states will provide some form of legal recognition to same-sex couples: marriage in Massachusetts; civil unions in Vermont, New Hampshire and Connecticut; domestic partnerships in Maine. Rhode Island does not allow same-sex marriages, but does not explicitly ban them, making the state one of only a few whose gay residents can legally marry in Massachusetts. As ceremonies for gay couples go mainstream in New Hampshire, some innkeepers, hotel managers and tourism marketers are working to get some of the expected upswing in business.

Albeit with a tax consequence. But some, perhaps many, gay and lesbian workers won't have the same opportunity. That's because employers who self-insure their workers - as opposed to buying a health care plan through an insurance company - will have discretion to extend or deny benefits to their employees' gay partners. And the self-insured population is not a small one in New Hampshire, according to the state insurance department: It's estimated at 46 percent of the insured population. Wal-Mart, the world's biggest retailer, for example, is self-insured. So is Target. Wal-Mart does not extend benefits to same sex partners. Target, meanwhile, does.

Sometimes during the summer months on a Saturday, three-quarters of the registrations are civil partnerships as opposed to marriages." Perhaps predictably, though, the negative side is starting to emerge. Lawyers across the country are reporting a steady trickle of applications to dissolve their partnerships.

Under the new law, gay and straight couples will be eligible to form civil unions after living together for five years. They will have rights similar to those granted to married couples on such matters as inheritance, pensions and child custody. Uruguay's Senate passed the bill unanimously after the lower house approved it last month, a congressional spokesman said. The country's center-left president is expected to sign it into law. Several cities, including Buenos Aires and Mexico City, already have gay civil union laws on the books. Uruguay's law would be the first nationwide measure in Latin America, which is home to about half the world's Roman Catholics.

Rudd says his position has always been that marriage is between a man and a woman, but he is committed to developing a nationally consistant relationships register. "A relationships register, nationally consistant of the type we've had in Tasmania since 2004, we believe is a positive and productive way forward," he said. "Particularly if you add to it appropriate nationally uniform legistlation and to remove any impediments to same sex couples in relation to inheritance law, taxation law and social security law."

QUICK LOOK:Civil unions are an inadequate substitute for marriage. Creating a separate, new legal structure to confer some benefits on same-sex couples neither honors American ideals of fairness, nor does it grant true equality. The results are clearly visible in New Jersey, which continues to deny same-sex couples some of the tangible civil benefits that come with marriage. Gov. Jon Corzine of New Jersey has long said that he would sign a measure granting the right to marry to couples of the same sex. We are heartened that he has declared that that should happen sooner rather than later. We hope Mr. Corzine intends to prod legislators into passing such a law early in the 2009 session. That would make New Jersey the first state to legalize marriage for same-sex couples through legislative action.

QUICK LOOK:This week, the New Hampshire state House will be asked to right a historic wrong by approving civil unions granting same-sex couples all the state rights enjoyed by heterosexual couples. It should do so resoundingly. It is antithetical to freedom to discriminate against people based on their sexual orientation. That said, the Senate should not pass the bill in haste but give civil unions a full public hearing. It would serve no one's interest, least of all the gay couples who would benefit from the change, if opponents believe they have been railroaded. If the Senate passes the bill after ample discussion, Gov. John Lynch should affirm the importance of equal rights for all by signing it. After much turmoil, Vermont legalized civil unions in 2000. The change has had no effect on the lives of straight couples, but it has enhanced Vermont's reputation as a tolerant place. Some New Hampshire homosexuals fighting for the right to be united in marriage fear that their cause will be set back by the approval of civil unions. In the short run, they're probably right; in the long run, they're probably wrong.
