New York Times, Posted: 4/29/2010, 2:12 PM American expatriates are having a more difficult time living and working abroad, causing a small but growing number of them to renounce their United States citizenship. But there’s another group of Americans who could be adding to that tally: same-sex couples. Many same-sex couples who decide to leave the United States head for countries that recognize their unions. In fact, when we wrote a story about the extra costs same-sex couples face here in America, we learned that many leave because of immigration obstacles. Several readers left comments stating that they could not sponsor their same-sex partners for American citizenship — so they decided to migrate to places like Canada, where it’s easier to gain permanent resident status for couples since only one partner has to qualify. Besides, gay marriage is recognized there. Not all same-sex couples who move abroad will ultimately renounce their citizenship, of course, but it’s not out of the realm of possibility. David Cohen, a senior partner at Campbell Cohen, an immigration law firm in Montreal, said he had seen a significant increase in the number of same-sex couples who emigrated from the United States to Canada over the last 10 years. The couples head north for many reasons, he said, including “what they view as a prejudicial tax system, or they don’t feel they are entitled to the same benefits as heterosexual married couples, or they feel there is more tolerance,” Mr. Cohen said. “And there have been a fair number of Americans who can include their same-sex partner in the application. Only one member of a couple has to qualify for permanent residence status to come to Canada.”

It's threatening to widen into a public chasm, pitting elements of the pro-reform coalition against one another while giving anti-reform forces a potent new weapon. The hitch? Gay rights. Specifically, the rights of gay couples, like heterosexual ones, to sponsor their spouses, children, and other family members for green cards. The system's known as "family unification" and it's been the cornerstone of US immigration policy for decades, accounting for two-thirds to three-quarters of annual visa admissions. Beginning last June, gay rights activists have quietly pushed for a bill, known as the Uniting American Families Act (UAFA), which would allow gay and lesbian couples to obtain green cards for their same-sex companions. At last count, the bill had 121 House co-sponsors, including most recently, Democratic representative Maxine Waters, who endorsed the measure on 24 February. Waters is a powerful member of the Congressional Black Caucus, and a senior Democrat on the House subcommitte that oversees immigration policy. UAFA supporters say their bill merely acknowledges the reality of homosexual unions across borders. They also note that UAFA defines a same-sex companion as a "permanent partner" rather than a "spouse," which means it still technically conforms with the 1996 Defense of Marriage Act, which restricts the legal definition of marriage to a heterosexual union.

Agenda, Posted: 3/22/2010, 2:35 PM *WATCH*: An estimated 200,000 demonstrators descended on the National Mall on Sunday to urge passage of comprehensive immigration reform, including several hundred protesters advocating for LGBT inclusion in the legislation. As they danced to salsa music and listened to speeches, participants at the rally and the march that followed called on President Obama and Congress to keep their promise to enact reform legislation before the year’s end. Latino groups — waiving signs reading “Reform not Raids” and “Obama Cumple tu Promesa” — comprised the majority of those participating in the demonstration, although contingents of Asian and Caribbean groups also took part. The LGBT contingent, which included about 300 people, advocated for their inclusion as part of the broader immigration movement as well as for incorporating the Uniting American Families Act in reform. The bill would enable LGBT Americans to sponsor same-sex partners who are foreign nationals for residency. Rachel Tiven, executive director of Immigration Equality, said the showing was “a nice visible contingent” that demonstrated “how much the LGBT community is here for comprehensive immigration reform that includes all families.”

Organizers are predicting that 100,000 people -- including perhaps 500 from Immigration Equality -- will gather on the National Mall to demand immigration reform from Congress. In 2006, a study conducted by Immigration Equality and the Human Rights Campaign revealed that the U.S. immigration system systematically discriminates against LGBT people and their families by denying immigration benefits to the foreign-born same-sex partners of U.S. citizens and permanent residents.

Chuck Schumer sent a letter to some of his LGBT constituents in New York signaling that comprehensive immigration reform would include a provision for LGBT families. “The failure to recognize permanent partners in the application for legal permanent residency is a major concern for many Americans,” reads the letter, which was obtained by Immigration Equality. Schumer then reiterates his support for the Uniting American Families Act, which would allow U.S. citizens and green card holders to sponsor their same-sex partners for permanent residency. “I support this principle of immigration reform,” he writes, “and I am working on introducing a comprehensive package that would address this issue along with a host of immigration issues. … At this time, I believe that the only way to pass meaningful and effective immigration reform is through a comprehensive bill, not through piecemeal legislation."

She told The Post yesterday that the smooch, which her husband denied, was the proof she needed to convince her that her marriage was a loveless, sexless sham. "Once I saw him in the car, that's when I had enough," said Samina, who was represented by the law firm of Dominic Barbara. "I left that day." Samina met Farrukh, 35, two years ago at a singles event for professional Muslims. For weeks, Samina said, she ignored the obvious signs, including their bizarre living arrangement. Samina moved with Farrukh into a one-family house in Westbury he was sharing with his friend, the friend's wife and their son. Farrukh denied the marriage was a sham. Earlier this week, the Canadian Press reported that an early draft of the guide included references to gay-rights milestones that didn't make the final draft. When asked on Wednesday whether he was the one who blocked the passages from making the final draft, Kenney said: "I did not do such a thing. No, no, you are wrong." On Thursday, Liberal MP Marlene Jennings and NDP MP Olivia Chow called for passages detailing the legalization of same-sex marriage in Canada to be restored to the guide immediately and demanded the minister apologize. But Kenney was having none of it. "We are proud of this guide and we believe it does reflect the diversity of Canada," Kenney told the House. Jennings called it a "guide on Conservative citizenship" while Chow said newcomers "need to know that gaybashing is illegal." "Perhaps I have a higher estimation about new Canadians," Kenney replied. "They're not all potential gay-bashers. They come here to respect our laws."

These two defining characteristics, as well as what he learned about his family’s immigrant roots through extensive genealogical investigation, have compelled him to dedicate his legal career and much of his personal time to fighting for the rights of immigrants and LGBT individuals in his adopted country.

President Obama said the ban was not compatible with US plans to be a leader in the fight against the disease. The new rules come into force on Monday and the US plans to host a bi-annual global HIV/Aids summit for the first time in 2012. The ban was imposed at the height of a global panic about the disease at the end of the 1980s. It put the US in a group of just 12 countries, also including Libya and Saudi Arabia, that excluded anyone suffering from HIV/AIDS. The BBC's Charles Scanlon, in Miami, says that improving treatments and evolving public perceptions have helped to bring about the change. Rachel Tiven, head of the campaign group Immigration Equality, told the BBC that the step was long overdue. "The 2012 World Aids Conference, due to be held in the United States, was in jeopardy as a result of the restrictions. It's now likely to go ahead as planned," she said.

But that's exactly the danger that Republican lawmakers in Arizona have set for the rest of the country, and why Americans of conscience must rise to the challenge. Strong-armed to power in a sad display of one-party control of state governance, the law compels police to investigate the citizenship status of ordinary Arizonans. For advocates of LGBT rights, in and outside the gay community, the law holds troubling parallels with some of the worst chapters of recent U.S. history. It also recalls a lesson from an important gay-rights battle in Cincinnati that may sharpen coordinated resistance. In its perversion of the professed conservative desire for checks on government intrusion, the law evokes the McCarthy era's war on so-called sex deviants. That reign of error in the early Cold War, as historian David Johnson documents in his 2004 book Lavender Scare, focused the resources of the federal state on thousands of trained and taxpaying workers. It succeeded in ferreting out hundreds of homosexuals and served them up as trophies to placate the prejudice and grand-standing ambitions of a few Congressional overseers.

The GOP is now doing to Latinos what it did to gays. Its leaders - by backing the Federal Marriage Amendment in the last decade and now the Arizona law in this - are essentially saying that they do not understand how these measures could impact a minority's collective psyche. Whatever the technical merits of either measure - and there were intellectually coherent (if, to my mind, unpersuasive) defenses of both - the lack of empathy or understanding is the real issue. It places the Republican "us" against the minority "them." This is not just a failure of empathy; it is failure of judgment. The votes of Latinos will be massively important in the very near future, and the number of people who know and love gay people grows daily.

Now, however, there is renewed energy and focus on the issue. And that, in turn, must be a wake-up call, and a rallying cry, for the LGBT community, too. Yesterday, President Obama called two key lawmakers – Senators Chuck Schumer (D-NY) and Lindsey Graham (R-SC) – to the White House to discuss moving immigration reform forward. That’s good news, but behind the optimism are serious questions to be answered about who reform will help, what it will contain and how it can pass what seems to be a deeply divided Congress. And within each of those questions are a myriad of issues related to the LGBT movement, too. There is no question, of course, that almost any reform will help some LGBT people. A path to citizenship, for example, will surely be welcome news for undocumented LGBT people. It is also essential, however, that comprehensive reform include the Uniting American Families Act (UAFA), a measure which would end discrimination against LGBT binational families and, at long last, afford lesbian and gay Americans the same opportunity to sponsor their significant others for residency in the United States.
