Associated Press (AP), Posted: 3/23/2010, 4:38 PM A federal judge ruled Tuesday that a Mississippi school district violated a lesbian student's rights by refusing to allow her to bring her girlfriend to the prom, but he said he would not force the school to hold the event. The ACLU sued in U.S. District Court to force the Itawamba County school district to sponsor the April 2 prom and allow Constance McMillen to escort her girlfriend and wear a tuxedo. School officials said in court they decided to call off the prom at Itawamba Agricultural High School because McMillen's challenge to the rules had caused disruptions. U.S. District Judge Glen H. Davidson denied the ACLU's request for a preliminary injunction. Davidson did say in his order that the district had violated McMillen's constitutional rights by denying her request to bring her girlfriend and wear a tuxedo. "We consider this a victory," said ACLU Mississippi legal director Kristy Bennett. But Davidson said a private prom parents are now planning will serve the same purpose as the school prom. He wrote in his ruling that "requiring defendants to step back into a sponsorship role at this late date would only confuse and confound the community on the issue."

The American Civil Liberties Union is suing in U.S. District Court to force the Itawamba County school district to sponsor the prom and allow Constance McMillen to escort her girlfriend and wear a tuxedo. Schools Superintendent Teresa McNeece and school board Chairman Eddie Hood testified that they had discussed not sponsoring the prom even before McMillen challenged a rule that prohibits same-sex dates. They said they had concerns about liability problems, including possible use of alcohol and drugs at a school-sponsored event. But they also said they decided to call off the April 2 prom at Itawamba Agricultural High School because McMillen's challenge to the rules had caused disruptions. "We were being hounded every day. Our students were being hounded," McNeece said. "We were having a tough time of any bell-to-bell instruction." On cross-examination, school officials did not give specific examples of classroom disruptions. McMillen first approached school officials about bringing her girlfriend in December, and again shortly before a Feb. 5 memo about prom rules was circulated to students. Same-sex prom dates had been banned in the past, but she had hoped school officials would grant her request.
Associated Press (AP), Posted: 3/21/2010, 3:25 PM A Fresno City College science instructor violated a campus anti-discrimination policy when he told students that homosexuality is a mental disorder that should be treated with psychotherapy, campus administrators have concluded. Christopher Villa, vice president of student services, reported the findings last week in a letter to three students who had lodged complaints against health sciences instructor Bradley Lopez. The campus' student newspaper published Villa's letter Wednesday. "Dr. Lopez engaged in conduct that could result in the creation of a hostile learning environment by unreasonably interfering with students' learning by making insulting comments directed at homosexuals," Villa wrote. He added that while instructors are free to offer opinions that may offend students or be at odds with other professionals, Lopez crossed the line by making statements "unrelated to any legitimate course objective." Lopez's lawyer, Charles Magill, said that only one of the three complaining students was enrolled in Lopez' class and she had misinterpreted his remarks.
Jackson Clarion-Ledger (Miss.), Posted: 3/20/2010, 2:16 PM An attorney for the Itawamba County School District said the school board called off a high school prom to settle the "very explosive and disruptive issue" of the district's ban on same-sex dating, according to a filing in U.S. District Court on Friday. The filing by school board attorney Benjamin Griffith states that Itawamba Agricultural High School senior Constance McMillen "wishes to make the defendant district the site for a national constitutional argument over gay and lesbian rights." According to the filing, parents have organized a private prom at a furniture mart in nearby Tupelo. Now that the school district has withdrawn from the event, any constitutional claims are irrelevant, Griffith wrote. ACLU attorney Christine Sun saw information about the private dance in the filing. "Constance has not been invited, so it is clear to me that what is happening is that the school has encouraged a private prom that is not open to all the students," she said. "That's what Constance is fighting for - a prom where everyone can go." McMillen is receiving accolades outside her hometown for her stance. DeGeneres, who is gay, called her part of a new generation of leaders for her stand for gay rights and presented her with a $30,000 college scholarship check from Web site Tonic.com.

Supporters of a bill sponsored by an openly gay Colorado congressman say that the case underscores the need for legislation that guarantees equal treatment for LGBT youth.Democratic Rep. Jared Polis had introduced his bill, The Student Anti-Discrimination Act, in January, but the events in Fulton, Miss. show the timely nature of the proposed measure, supporters say. The National Stonewall Democrats issued a petition, together with a statement saying, "What’s happening in Mississippi unfortunately happens all too often around the country, and not just during Prom season. Lesbian, gay, bisexual, and transgender students--and those students who are perceived to be LGBT or who associate with LGBT students--are subjected to discrimination, including harassment, bullying, violence; and are deprived of equal access to educational opportunities."

Washington Post, Posted: 3/14/2010, 2:06 PM Virginia Attorney General Ken Cuccinelli II said Friday that it remains his legal advice that the state's public colleges and universities should remove language dealing with sexual orientation from campus anti-discrimination policies. In some of his first public comments on the issue since his letter last week to the universities sparked an uproar on campuses, Cuccinelli (R) said he continues to believe that the institutions are limited in their ability to adopt such policies without authority from the General Assembly. The legislature has repeatedly declined to put legal protections for gay men and lesbians into Virginia code. "What I said in my March 4 letter was accurate advice under Virginia law, and it still stands," Cuccinelli said in brief comments to reporters after addressing lawmakers on an unrelated issue. Universities, he said, "don't have any more authority than the General Assembly gives them, which is a similar position as the localities. And until the General Assembly gives them more authority, they're quarantined by what they've got." This week, after Cuccinelli's opinion drew national attention, Gov. Robert F. McDonnell (R) issued a non-legally binding executive directive to the state workforce, warning that anyone who discriminates on any grounds, including sexual orientation, could face reprimand or termination.

McMillen, a senior at Itawamba Agricultural High School in Fulton, wants to bring her sophomore partner to the prom. School officials first refused, and then, rather than deal with the controversy, canceled the April 2 prom altogether, shifting responsibility to private groups. Gone are the days when the worst administrators had to handle were occasional fights and smoking on campus. Today, the issues are complex. Gay teens are more open about their sexual preference and they are asking that they be allowed to exercise the freedom to be who they are. Students used to keep their sexual preference to themselves, fearing ridicule. But now they are challenging the system and have local school districts running scared. Just like the McMillen case, the same uncomfortable debate occurred when Sturgis decided to wear a tuxedo for her yearbook senior portrait rather than the traditional drapes deemed more appropriate for girls. Officials at Wesson Attendance Center refused, setting off a debate that went national. I am not suggesting that students be allowed to stomp on the handbook. But in deciding the fate of these two girls, schools have entered the legally arguable territory of being the arbiter of proper social mores.

QUICK LOOK:Sunday’s ombudsman column sparked a healthy discussion about whether The Post should loosen its policies governing when to disclose a person’s sexual orientation. The column dealt with last month’s tragic murder of D.C. middle school principal Brian Betts and The Post’s decision not to reveal he was gay, despite the fact he was “out” to friends and coworkers and although police said publicly that he was homosexual. The Post held firm, even after police subsequently revealed that Betts had met at least one person charged in his murder through a phone-sex chat service. Since the column appeared, a handful of gay and straight Post journalists, including two supervising editors, have contacted me to say they believe there should be a review of the policy governing when to reveal sexual orientation. It’s a good discussion to have. Post policy says: “A person's sexual orientation should not be mentioned unless relevant to the story... When identifying an individual as gay or homosexual, be cautious about invading the privacy of someone who may not wish his or her sexual orientation known.” Defining “relevant” is the challenge. It can be relevant if a closeted gay lawmaker promotes anti-gay legislation. And I felt it was relevant to disclose that Betts was gay, especially because the circumstances of his murder were similar to others locally and nationally.

QUICK LOOK:The prospect of preferential hiring on the basis of homosexuality and transgender identity poses troubling questions. At this point it’s a largely hypothetical issue. In most states employers can fire or refuse to hire LGBTs solely because of their sexual orientation or gender identity. So the idea of asking for special preferences is more than akin to the metaphor of beggars acting like choosers. But in the country’s more “progressive” institutions, the notion of gay affirmative action is not so theoretical. At the 2006 annual meeting of the National Association for College Admission Counseling, the subject of affirmative action for gay students came up and found some adherents, including an admissions officer at Vermont’s prestigious Middlebury College. The school’s assistant director of admissions told the website Inside Higher Ed that gay students bring “a unique quality,” which is important as the school tries hard not “to be too homogeneous.” Don’t be surprised if, within the next few years, the nation’s top colleges add homosexuality to their list of applicant “attributes,” giving gay students the same leg up that athletes, children of alumni, and some racial minorities also enjoy.
