The Itawamba County school board Wednesday canceled the school's planned April 2 dance after a lesbian student challenged the district's policy against same-sex dates. As news of the board's decision spread across the nation, Matthew Sheffield of the Mississippi Safe Schools Coalition said his office was flooded by people looking to help. Among those is New Orleans hotel owner Sean Cummings, who offered to transport the students by bus from the northeast Mississippi city and host the prom at one his properties free of charge. Film director Paul Saltzman offered to provide a screening of his movie Prom Night in Mississippi as part of the entertainment at a private prom for the students. The documentary, shot in 2008, is about the first racially integrated prom at Charleston High School in North Mississippi. Constance McMillan, the 18-year-old senior who challenged the school district's policy, recorded a video message on a Facebook page set up to support her decision. "I never thought in a thousand, billion years that there would be so many people that would support something that I am doing," she said in the message. "I think that it is great there are that many people out there that understand the difference between what is wrong and right."
New York Post, Posted: 3/12/2010, 5:23 PM A Bronx charter school is under fire from parents who say a teacher bullied kids -- and even forced one child to tell his crush, a girl, that he was gay. According to court papers filed this week, the teacher, Jared Alessandroni, 29, threatened to "out" a straight 9-year-old boy, James Pastrana, to his class at the South Bronx Charter School for International Cultures and the Arts, unless James told his crush he was gay. "I was so humiliated," said Pastrana, who reluctantly scribbled the false confession in a note to the girl. "It started to spread around the whole class and then everyone wanted to call me gay." "The teacher's conduct was reprehensible," said Patrick Mullaney, the lawyer for the boy. Alessandroni, who left the school last year, said the allegations were probed by the Department of Education and no wrongdoing was found. "This was thoroughly investigated by the New York City Board of Ed," he told The Post. "There were copious amounts of paperwork, and every single aspect of it was cleared without any caveat. They did interviews with the students and witnesses, and they all led to the same conclusion, that I was cleared on every count . . . I just hope that [the legal process] doesn't further upset or hurt James."

Many said they felt the issue of whether same-sex dates should be allowed at the dance had been blown out of proportion. “I don’t think it should have been such a big deal,” said junior Preston Moffett. “Students wouldn’t have minded if those two people had gone to the dance. “But I am glad the school is standing up for what they believe in and fighting against it.” The Itawamba County School District canceled the dance on Wednesday, the deadline set in an ACLU demand that it allow same-sex dates to attend the prom. The ACLU sent its letter to the school on behalf of senior Constance McMillen, who was told by school officials that she could not attend the dance with her girlfriend. The school board’s statement did not cite McMillen or the ACLU but said the dance was canceled “due to distractions in the educational process.” Savannah Denson said she didn’t agree with the district’s decision. “I think she should be able to go to prom with her girlfriend,” she said. “God gives us the free will to be who we are and choose the people around us. She has the freedom.” IAHS senior Lindsey Begley said it was sad that this will be one of the last memories for the senior class. “We wish this hadn’t happened,” Begley said. “No one cared whether she went or not. No one was going to be uncomfortable. “This was going to be our last hurrah.”
CNN, Posted: 3/11/2010, 6:22 PM A Mississippi high school faces a lawsuit over its decision to cancel its prom rather than allow a lesbian high school student attend with her girlfriend. The lawsuit, filed by the American Civil Liberties Union, alleges that officials at Itawamba Agricultural High School in Fulton, Mississippi, are violating the student's First Amendment right to freedom of expression. The ACLU asked the U.S. District Court for the Northern District of Mississippi to reinstate the prom. "All I wanted was the same chance to enjoy my prom night like any other student. But my school would rather hurt all the students than treat everyone fairly," said the student, 18-year-old Constance McMillen, in an ACLU news release. "This isn't just about me and my rights anymore -- now I'm fighting for the right of all the students at my school to have our prom." At the center of the lawsuit is a memorandum from the school to students, dated February 5, which states that prom dates must be of the opposite sex. Also, when McMillen expressed a desire to wear a tuxedo to the prom, the superintendent told her only male students were allowed to wear tuxes, according to court documents. Superintendent Teresa McNeece also told McMillen that she and her girlfriend could be ejected from the prom if any of the other students complained about their presence there, according to the documents.

"Due to the distractions to the educational process caused by recent events, the Itawamba County School District has decided to not host a prom at Itawamba Agricultural High School this year," school board members said in a statement released through the district’s attorney. "It is our hope that private citizens will organize an event for the juniors and seniors. We sincerely apologize for any inconvenience this causes anyone," the message concluded. The announcement alarmed Constance McMillen, the 18-year-old senior who had petitioned the district to change its policy. "Oh, my God. That's really messed up because the message they are sending is that if they have to let gay people go to prom that they are not going to have one," she said. "A bunch of kids at school are really going to hate me for this, so in a way it’s really retaliation." School officials told McMillen last month that she could not bring her sophomore girlfriend to the prom and also told her she could not wear a tuxedo. The school then circulated a memo that prohibited same-sex dates. McMillen contacted the American Civil Liberties Union of Mississippi, which earlier this month issued a letter demanding the school change its policy. The letter gave the district until today to decide on a course of action.

Bob McDonnell today instructed state agencies not to discriminate against gay and lesbian workers during the hiring process or in the workplace. His directive comes in the wake of a recent firestorm ignited after Attorney General Ken Cuccinelli wrote to Virginia college and university officials telling them they lack the legal authority to adopt employment policies with protection for gay workers. While McDonnell's missive takes a strong stand on Virginia's non-discrimination posture, it doesn't carry the weight of law, as an executive order does. His Democratic predecessors, former Govs. Mark Warner and Timothy M. Kaine, both included sexual orientation as a protected category in their anti-discrimination executive orders. McDonnell has said it is up to the General Assembly to change state law; he and then- Gov. Kaine clashed over that point in 2006 when McDonnell was the new attorney general. Efforts to add sexual orientation protections to state law have been rejected by the Republican-controlled House this year.

The governor issued his statement after Virginia Attorney General Ken Cuccinelli II, a Republican, called such measures illegal in a letter written to the schools. “It is my advice that the law and public policy of the Commonwealth of Virginia prohibit a college of university from including 'sexual orientation,' 'gender identity,' 'gender expression,' or like classification as a protected class within its non-discrimination policy absent specific authorization from the General Assembly,” Cuccinelli said in his letter. And he advised the schools should “take appropriate actions to bring their policies in conformance with the law and public policy of Virginia.” While McDonnell's office called Cuccinelli's advice “consistent with all prior opinions from the office of the attorney general over the last 25 years on the subject,” spokesman J. Tucker Martin added, “The governor will appoint board members based solely on their ability and on their strong commitment to educational excellence in Virginia. The governor expects that no Virginia college or University, or any other state agency, will engage in discrimination of any kind.”
The Advocate, Posted: 3/9/2010, 10:31 AM A nationwide school event launched by religious conservatives to counter the Gay, Lesbian, and Straight Education Network’s annual Day of Silence will be promoted and overseen for the first time next month by Exodus International, an “ex-gay” organization with extensive ties to so-called conversion or reparative therapy. Created in 2004 by the conservative legal organization Alliance Defense Fund, the Day of Truth is scheduled for April 15, one day before GLSEN’s Day of Silence event. According to its website, Day of Truth seeks “to affirm every student’s constitutional right to free speech and to provide an opportunity to have an honest conversation about sexuality.” Last year the ADF announced that Exodus would oversee implementation of the event in 2010, though the ADF’s legal team remains involved. GLSEN representatives see the competing event differently. “We find it unfortunate that the ADF and now Exodus International tries to spin a message counter to ours, that anti-LGBT bullying is wrong,” GLSEN spokesman Daryl Presgraves said. “Students today feel more welcome and accepted, and have a sense of belonging that didn’t exist 20 years ago. Part of the Day of Truth is to take away from that, to spread the mistruths about 'conversion therapy.'”

This follows a decision late last month by the governing body and management of Mthwalume High School, on the province's South Coast, to remove 300 pupils from the school and to close down the boarding house after two girls were seen kissing openly in a dormitory. The two named 27 other pupils as lesbians. Commission spokesman Javu Baloyi said the commission wrote to the provincial department of education demanding answers. Lindani Mkhize, of the local branch of teachers union Sadtu, said the matter was resolved and the children were back at school on March 1.
Virginian-Pilot, Posted: 3/6/2010, 12:10 PM The revelation Friday that Virginia Attorney General Ken Cuccinelli (R) is pressing state colleges and universities to remove discrimination policies that provide protections for sexual orientation sparked an outcry from Democrats and interests groups. "This is big government at its worst from a candidate who ran on small government," said U.S. Sen. Mark Warner (D-Va.). "Our colleges and universities are more than capable of setting policies that work for them without meddling from Ken Cuccinelli. I think Governor McDonnell would be wise to reign in his Attorney General and get him back to doing the work of the people." Former Gov. Timothy M. Kaine both recognized "sexual orientation" as a protected category in non-discrimination orders they issued while governor. But current Gov. Bob McDonnell's equal opportunity executive order doesn't include that language. He and Cuccinelli believe the legislature must make that kind of change in the law. Bills seeking to accomplish that were defeated in the Republican-controlled House this year.

QUICK LOOK:Sunday’s ombudsman column sparked a healthy discussion about whether The Post should loosen its policies governing when to disclose a person’s sexual orientation. The column dealt with last month’s tragic murder of D.C. middle school principal Brian Betts and The Post’s decision not to reveal he was gay, despite the fact he was “out” to friends and coworkers and although police said publicly that he was homosexual. The Post held firm, even after police subsequently revealed that Betts had met at least one person charged in his murder through a phone-sex chat service. Since the column appeared, a handful of gay and straight Post journalists, including two supervising editors, have contacted me to say they believe there should be a review of the policy governing when to reveal sexual orientation. It’s a good discussion to have. Post policy says: “A person's sexual orientation should not be mentioned unless relevant to the story... When identifying an individual as gay or homosexual, be cautious about invading the privacy of someone who may not wish his or her sexual orientation known.” Defining “relevant” is the challenge. It can be relevant if a closeted gay lawmaker promotes anti-gay legislation. And I felt it was relevant to disclose that Betts was gay, especially because the circumstances of his murder were similar to others locally and nationally.

QUICK LOOK:The prospect of preferential hiring on the basis of homosexuality and transgender identity poses troubling questions. At this point it’s a largely hypothetical issue. In most states employers can fire or refuse to hire LGBTs solely because of their sexual orientation or gender identity. So the idea of asking for special preferences is more than akin to the metaphor of beggars acting like choosers. But in the country’s more “progressive” institutions, the notion of gay affirmative action is not so theoretical. At the 2006 annual meeting of the National Association for College Admission Counseling, the subject of affirmative action for gay students came up and found some adherents, including an admissions officer at Vermont’s prestigious Middlebury College. The school’s assistant director of admissions told the website Inside Higher Ed that gay students bring “a unique quality,” which is important as the school tries hard not “to be too homogeneous.” Don’t be surprised if, within the next few years, the nation’s top colleges add homosexuality to their list of applicant “attributes,” giving gay students the same leg up that athletes, children of alumni, and some racial minorities also enjoy.
