The Advocate, Posted: 6/8/2010, 10:00 AM The U.S. Department of Housing and Urban Development announced Monday that it will now require grant applicants seeking HUD funding to comply with state and local antidiscrimination laws that protect lesbian, gay, bisexual, and transgender individuals. "We're using every avenue to shut the door against discrimination," HUD secretary Shaun Donovan said in a statement. "Today, we take an important step to insist that those who seek federal funding must demonstrate that they are meeting local and state civil rights laws that prohibit discrimination based on sexual orientation or gender identity." An estimated 20 states and the District of Columbia currently prohibit discriminating against people in housing on the basis of their sexual orientation, and 12 states plus the District of Columbia have the same prohibition on gender identity discrimination, according to a release from HUD. HUD spokesperson Brian Sullivan said the department had "limited authority" as it specifically relates to LGBT people since cities and states do not have uniformed policies and no federal law protects LGBT people against discriminatory housing practices. "We can't be making law, but we went as far as we could," he said. Sullivan added that the adjustment was not a regulatory change but instead an administrative requirement. Traditionally, HUD has required all applicants for competitive grant funding to comply with all applicable federal fair housing and civil rights requirements including those expressed in Fair Housing Act; Title VI of the Civil Rights Act of 1964; Section 504 of the Rehabilitation Act of 1973; and Title II of the Americans with Disabilities Act.

Last month, the Saudi government took its drive against homosexuality a step further when it banned the recruitment of gay and lesbian workers, including those from other countries. In a May 26 memorandum, the consular section of the Royal Embassy of Saudi Arabia reminded recruitment agencies in Manila to be stricter in screening job applicants to the Middle Eastern country. “Officials of recruitment agencies who are responsible in conducting interviews of job applicants to Saudi Arabia are strongly advised to screen them thoroughly so that those belonging to the third sex are excluded," the memo read. The accreditation of recruitment agencies found to have failed to observe this advisory would be permanently terminated, it added.

Attorney General Andrew Cuomo has forced the flannel and khaki outpost to make some changes, including nixing a rule about employee "personal appearance" that banned men from wearing women's clothing and ladies from dressing as guys. "This shows me that there's faith and hope. There might be a domino effect, that's what I'm hoping for," said Joi-elle White, 35, a transgender member of Make the Road New York. The community group complained to Cuomo's office about what it called a pattern of discrimination against transgender job hunters. A probe confirmed the complaints, officials said. The retailer - which employs more than 2,000 people in its 61 New York stores - signed a settlement deal promising to change its policies and employee handbook. "To avoid further expense and the distraction of a prolonged argument, [we have] agreed to a compromise settlement in this case, with the understanding that AEO is not admitting to the findings," a company spokeswoman said. "We wholeheartedly believe that transgender individuals should be treated equally," she added in a statement.

The Harvey Milk LGBT club and Pride at Work are holding a noontime rally today at Pier 33 in support of Vincent Atos, a former deckhand on Hornblower's Alcatraz cruises, who claims he was last year dismissed for "acting too gay." Perhaps not incidentally, Atos was also a union organizer. "What it was alleged Vincent did was make inappropriate sexual comments in the workplace of a gay nature," says David Waggoner, a lawyer and co-president of the Milk Club. "But many of his co-workers routinely made comments of a sexual nature that were heterosexual. One of his managers even viewed porn in the workplace. So this highly sexualized workplace was the norm. ... He was fired essentially because he was a gay union organizer." Calls to Hornblower's attorney, Katie Patton Acevedo, have not yet been returned. When asked if Atos would still be at sea if he were a straight union organizer, Waggoner chuckled. "Good question."

On Monday, participants will receive training how to press for an trans-inclusive ENDA with lawmakers. Additionally, citizen lobbyists will hear from representatives from the White House, the Transportation Security Administration, the U.S. Census Bureau, the Gay & Lesbian Alliance Against Defamation and the Transgender Civil Rights Project of the National Gay & Lesbian Task Force. Crew store in Manhattan to protest employment discrimination against transgender job applicants. Organizers have filed a complaint against J. Crew with the New York State Attorney General’s Office, alleging job discrimination at 24 retail stores in the Big Apple. Researchers have identified J. Crew as a violator of the New York City Human Rights Law. When equally qualified job applicants applied for positions at J Crew, non-transgender applicants were consistently hired over transgender applicants, the study found. Transgender and gender non-conforming activists will call on J. Crew to address discrimination by adopting a non-discrimination policy and including it in all job listings and applications; training employees about non-discrimination policies and practices; and ensuring that transgender and gender non-conforming people are free from harassment on the job. The report to be released, titled “Transgender Need Not Apply: a Report on Gender Identity Job Discrimination,” also found a 42 percent net rate of discrimination for transgender job applicants, a high figure in comparison to rates documented for other populations such as African-Americans and the elderly. In addition, 49 percent of transgender workers surveyed reported that they have never been offered a job in the time that they have lived openly as transgender.

But the city organisation, which provides support for gay, lesbian and bisexual people across the South West, claims the position requires someone with experience of gay and lesbian issues. The advert on the trust’s website is for a community helpline worker and administrator to work full-time at its city office. It states there is a “genuine occupational requirement” for the successful applicant to be lesbian, gay or bisexual. The organisation has received a complaint about the advert. But executive director Dr Michael Halls said: “This position for a helpline worker and administrator requires the person to answer the helpline and speak to people who have often suffered terrible emotional damage. If someone has spent years and years of their life desperately hiding from all of their family something they know will have them thrown out, they want to speak to someone who is sensitive to the issues of being gay or lesbian." In an email to the Echo, a jobseeker wrote: “I find this offensive that the advert is being specific about a person’s sexual orientation. … I am looking for a job in administration and found it amazing that I have to be something which is so specifically personal and nothing to do with my ability to do the job in order to apply for that post.”

Kate Summers was hired by Melanie and Anthony Vaughan to take their official photographs on their wedding day. But more than six months later Mrs Vaughan went to a national newspaper to complain about Ms Summers, who used to be a Ricky Gervais impersonator called Dave Stonestreet, for turning up at their wedding dressed as a woman. Ms Summers, of Windlesham Road, Brighton, was diagnosed as being transgender - biologically female but trapped in a man’s body - by doctors, in the year between her being booked to take the photographs and the August wedding at the Ramada Jarvis hotel in Brighton. Yesterday she said she had been left extremely upset after Mrs Vaughan accused her of ruining her big day. Ms Summers said: “Her comments have been vicious and offensive. You wouldn't dream of complaining that your wedding had been ruined because someone was gay or disabled. This diagnosis of being biologically female having lived 50 years as a male is not an easy thing to go through."

As evidence, gay-rights group Equality Virginia on Monday produced a Feb. 25 letter from a Maryland senator asking Northrop Grumman Corp .’s chief executive to locate the company’s corporate headquarters in Maryland rather than Virginia. The missive, penned by openly gay Maryland state Sen. Richard Madaleno Jr., contrasted his state’s “tolerant” policies with what he said were recent actions in Virginia “dismantling the few protections” afforded to gays and lesbians. Northrop Grumman has been praised by gay-rights supporters for its treatment of employees. Copies of the letter were distributed Monday at a news conference held in support of Virginia Sen. Donald McEachin’s legislation, which would codify a non discrimination policy that includes sexual orientation as a protected class.
