The group Restore Equality 2010 had sought to collect 700,000 petition signatures to give voters the opportunity to void Proposition 8, the bitterly fought measure that passed in 2008 and limited marriage to heterosexual couples. "Our signature collection effort may have fallen short, but we stand tall as being the only statewide campaign that fought for repealing Proposition 8 in 2010," Sean Bohac, chairman of the group's advisory panel, said in a written statement. The Sacramento Bee said the Restore Equality 2010 was an offshoot of the larger anti-Prop 8 group Restore Equality, which earlier had set a target date of 2012 for its attempt to repeal the marriage ban. The strategy behind the longer time line would be to build up a foundation of public support and vote during the presidential election when more young people would presumably show up at the polls. Bohac said his group would work for passage of a Prop 8 repeal in 2012.

A national group opposed to gay marriage is trying to shift the focus to that lightning rod issue in the coming weeks, putting pressure on the candidate seen as the most moderate of the three GOP challengers. Former congressman Tom Campbell, a supporter of gay marriage, finds himself under attack and his previous front-runner status reduced to a statistical tie with former Hewlett-Packard CEO Carly Fiorina in one poll. Another poll taken about the same time showed Campbell clinging to a narrow lead. The National Organization for Marriage is spending $300,000 on television ads that liken Campbell to Boxer on taxes and gay marriage, calling them two peas in the same liberal pod. Republicans who have been hard-liners on gay marriage and abortion typically perform well in GOP primaries in California but falter in general elections, when the voter base is far broader and more centrist. Republicans account for less than a third of the electorate. A business professor who holds a doctorate in economics, Campbell is the kind of middle-of-the-road Republican who would be likely to give Boxer a tough challenge as she seeks a fourth term in the Senate. But his opposition to Proposition 8, the 2008 ballot initiative that enshrined a ban on gay marriage in the California Constitution, has made him a target of the social conservatives who dominate the ranks of the state GOP. A Malawi judge Monday ruled that prosecutors have presented sufficient evidence to show that the couple, Tiwonge Chimbalanga and Steven Monjeza might have committed gross indecency. Mauya Msuku, one of the couple's lawyers said his clients are weighing whether to testify on their own behalf or not. “There are three or four options available. They might themselves testify and call witnesses, or they might choose just to testify themselves and never call witnesses, or they might choose only to call witnesses and never testify themselves; or they might choose to remain silent, never call witnesses and testify,” he said. Human rights groups are pressuring Malawi's government to drop the charges and repeal laws criminalizing homosexuality. Some Western countries have threatened to reduce aid to Malawi because of the case. But Malawi church leaders said last week the government should resist the pressure and maintain the current laws. Msuku said what matters is the legality of the government’s case and not the church’s opinion. “Whether the accused are guilty or not is not dependent on the opinion of a particular grouping or particular sector of society. It’s really about what the law says and our view is despite whatever opinion a particular sector of society thinks, we don’t think it’s relevant to the case,” Msuku said.

Tiwonge Chimbalanga, 20, and Steven Monjeza, 26, deny charges of gross indecency. They have now spent almost three months in custody in what is being seen as a test case for gay rights in Malawi. The judge said a full trial would proceed in April. Homosexual acts carry a maximum prison sentence of 14 years. But the men's lawyers have argued that their constitutional rights are being violated. The courtroom was packed for the hearing - the first stage in the legal process. About 50 people were reportedly unable to get in. "The court has established a prima facie case against the accused persons," said magistrate Nyakwawa Usiwa-Usiwa. The BBC's Raphael Tenthani in Blantyre says the two men looked relaxed during the proceedings. They waved to hundreds of on-lookers outside court as they were driven back to the city's Chichiri Prison. "We are sad that the couple will continue suffering for choosing to live the way they were born," said Gift Trapence from the recently formed gay rights group Centre for the Development of People (CEDEP). Malawi is a deeply conservative society.

Blogger John Morgan writes on The Pennsylvania Progressive, "I spend a fair amount of time in Harrisburg. I know who is closeted. Any closeted senator who votes for Eichelberger's bill will be outed. I also know a state senator who is wildly homophobic and is also an alcoholic. One of her rants will also be made public depending on her vote. This is fair warning." Pennsylvania already bans same-sex marriage, but this bill would enshrine the ban to the state constitution. The bill is sponsored by state senator John Eichelberger (pictured), who last year said of gays, "We allow them to exist."

Shawn Mitchell of Broomfield, whose 2003 bill limiting schools' abilities to teach about all forms of human sexuality triggered Tim Gill, a gay multi-millionaire, to open his wallet to help Democrats win control of the legislature in 2004. Rep. Mark Ferrandino, a Denver Democrat who is gay, was stunned when he looked around the room and saw the number of Republican lawmakers. Several have long backed gay issues, but he said he was surprised to see others. "Why shouldn't I be here?" Nikkel said. "They're all Coloradans, and I think it's important to understand their issues." Perez (D-Los Angeles) said that there is "no practical way" to repeal the state's anti-same-sex marriage ban this year. The comments are likely a fatal blow to the fledgling grassroots efforts to place a repeal measure of Proposition 8 before California voters in the fall. Already the majority of the state's LGBT rights groups had decided it makes more political sense to seek repeal of Prop 8 in 2012. The lack of institutional support has been impossible thus far for the grassroots activists to overcome. As the Bay Area Reporter disclosed last month, the group seeking repeal this year is grossly under-funded and has collected so few signatures they have discussed using paid signature gatherers to meet the April 12 deadline of turning in nearly 700,000 valid signatures to state officials. Asked about the repeal efforts this year, Perez said the effort is basically dead on arrival. "There is no practical way to get it on the ballot in 2010. That window has already closed," said Perez, who was sworn into the powerful speakership post Monday, March 1 during a ceremony that included the Los Angeles Gay Men's Chorus singing "God Bless America."

U.S. Magistrate Joseph Spero issued the order Friday as part of the first federal trial to examine if the U.S. Constitution prohibits states from outlawing gay marriages. Spero said Equality California, Californians Against Eliminating Basic Rights, an ACLU campaign committee and an umbrella group that oversaw the campaign against the ban must hand over all documents "that contain, refer or relate to arguments for or against Proposition 8," with the exception private communications between their core leaders. Lawyers for the ballot initiative's backers were required to provide similar documents to lawyers representing two same-sex couples who are suing to overturn Proposition 8.

That separate maneuver is now under review in the D.C. Court of Appeals, Washington’s highest local court. Opponents returned to local courts, seeking to block the effective date of the new law because, once that law took effect, it could not be pre-tested in a referendum. Both a local trial judge and the D.C. Court of Appeals refused to delay the law’s effect. The opponents then took their plea for delay to the Chief Justice, in his role as Circuit Justice for Washington, D.C., matters. The challengers told Roberts that they planned to appeal to the Supreme Court on the question of whether city officials had the legal authority to add a new limitation on the ballot measure process. The potential harms they cited included giving bisexuals a legal basis for pursuing group marriages and unmarried fathers an incentive to abandon their children. The arguments came in closing briefs in the first federal trial to examine whether state bans on same-sex marriages are constitutional. Chief U.S. Judge Vaughn Walker requested the briefs summarizing the respective sides' evidence to help him prepare for closing arguments. Walker plans to schedule closing arguments in the case sometime soon. Prop 8's opponents, representing two same-sex couples and the city of San Francisco, said overwhelming evidence at a 12-day trial in January showed that allowing same-sex couples to wed would benefit their children and the institution of marriage. Regardless of the intentions of individual voters, they argued, the Prop. 8 campaign was designed to appeal to fear and deep-seated prejudice. I was walking past 2223, a Castro District restaurant, at around 7 pm Monday night, when I spotted a bald attractive man at a table up against the Market Street facing window. Turned out to be Brett Andrews, the executive director of the Positive Resource Center, an AIDS org providing employment and benefits counseling. Seated opposite him was a white-haired older gentleman, who I instantly realized was none other than Vaughn Walker, the federal judge hearing the Prop 8 gay marriage case. I was momentarily stunned to see him in a social setting, enjoying drinks and laughs at the elegant 2223 restaurant. But I got over that, pulled my camera out of my pocket, and snapped some photos. I detected no hostility from either man, and went in to say hello and introduce myself to Walker. With a smile on my face, I approached their table, nodded acknowledgment to Brett, then extended my right hand to Walker, who was grinning and quite relaxed. (Was it the drinks that put him at such ease?)

"He's been an amazingly biased and one-sided force throughout this trial, far more akin to an activist than a neutral referee," the National Organization for Marriage said in a statement.
